Terms of Service

These terms govern your use of the CentPoll polling pipeline (the "Service"), operated by CENTPOLL LLC, a Florida limited liability company ("CentPoll", "we", "us"). By creating a workspace, signing in, or fielding a campaign, you agree to them. If you do not agree, do not use the Service.

1. The Service

CentPoll provides software, sample acquisition, and delivery infrastructure for political and civic research polling. You build surveys, define audiences from the L2 voter file or your own lists, and we route the field through one or more delivery channels (P2P texting, live caller, IVR, online panel).

You are the controller of the research questions and the data collected. CentPoll is the processor.

2. Your account

You must be at least 18 years old to use CentPoll. You are responsible for the security of your workspace credentials, including single-sign-on identities issued by Google, Microsoft, or LinkedIn.

You agree to provide accurate information when invited to a workspace and to keep that information current.

3. Acceptable use

You may not use CentPoll to: (a) field a survey designed to deceive, harass, or suppress a respondent's vote; (b) violate the Telephone Consumer Protection Act, CAN-SPAM, or analogous state law; (c) impersonate another person or organization; (d) circumvent the opt-out registry; or (e) attempt to deanonymize respondents.

CentPoll reserves the right to pause or terminate campaigns that we reasonably believe violate this section, with as much notice as is practical.

4. Pricing & payment

CentPoll bills on a pay-per-completion basis. A completion is a response that satisfies our quality criteria as documented in the methodology disclosure. Failed or auto-blocked responses are not billed.

Invoices are issued monthly. Past-due balances older than 30 days may result in field pause. We refund any unused balance on cancellation.

5. Data ownership

You own the questions you author and the anonymized responses generated by your campaigns. CentPoll retains rights to the underlying platform code, models, and aggregated benchmarks built across workspaces.

6. Confidentiality

Each party will protect the other's confidential information with the same care it uses for its own — and at least reasonable care.

7. Warranty disclaimer

The Service is provided "as is." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

8. Limitation of liability

Neither party will be liable for indirect, incidental, special, or consequential damages. Each party's total liability for any claim relating to the Service is capped at the fees you paid CentPoll in the twelve months before the claim.

9. Termination

Either party may terminate this agreement for any reason with 30 days' notice. CentPoll may suspend immediately for an acceptable-use breach or non-payment.

10. Changes to these terms

We may update these terms. We will email workspace owners at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.

11. SMS program terms

Program name: CentPoll civic polling.

Program description: CentPoll sends short, anonymous civic and political survey questions by SMS to U.S. registered voters and other adults who have provided prior express written consent. Each conversation is one survey: a brief greeting followed by 3–10 multiple-choice or numeric-rating questions, with respondents replying by number.

Message and data rates: Message and data rates may apply. Check with your wireless carrier for details.

Message frequency: Message frequency varies. Typically a subscriber receives messages only when an active polling campaign reaches their sample frame — most users receive fewer than one survey per quarter, and during a survey will receive one greeting plus one message per question (typically 3–10).

Support: For help, reply HELP to any message, email pvaldes@centpoll.com, or visit centpoll.com/legal/sms-consent.

Opt-out: Reply STOP (or STOPALL, CANCEL, UNSUBSCRIBE, END, QUIT) to any message to opt out. You will receive a single confirmation message and no further texts from CentPoll on that number. Reply START at any time to resubscribe.

Carriers are not liable for delayed or undelivered messages. Consent to receive these messages is not a condition of any purchase.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in Florida.
